Beavis Supreme Court Appeal: July 21 2015

It's all going to happen much sooner than we thought, apparently.
Barry Beavis's counsel, John de Waal QC, has advised that the Court will hear the case jointly with El Makdessi v Cavendish Square Holdings on 21-23 July 2015.
In that case, the Court of Appeal had previously ruled that Cavendish's contract terms were designed to deter breach, and were extravagant and unconscionable. Therefore they were penalties, and could not be enforced against Mr Makdessi.
Cavendish are now appealing that decision to the SC.
There is obviously a vast difference in the sums involved (millions of dollars vs £85) but the legal principles are the same in both cases.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. Indeed, lets hope this one has at very least a basic grasp of how PE actually work and what they do.I do Contracts, all day every day.0
