What next after a Final Charging Order

Hi All,

Please excuse me if this is posted in the wrong forum.

My family are owed a large sum of money from the sale of a property. This money was never paid and after much legal wrangling, we sued the person involved and they were ordered by the court to pay the money to us.

They did not do this and therefore (again after lots and lots of legal to-ing and fro-in) we went back to court and obtained a final charging order over the persons (and their partners) home. At the hearing the person declared that they had no equity in their home and the judge stated that he would take a dim view of any attempt to make an ‘order for sale’.

Our solicitors contacted the mortgagees of the property to try to establish if there was any equity available but they would not provide details without the persons consent which we do not believe they would give. Due to this our Solicitor now seem to think that their work is done and are offering little advice on the situation however we still don’t have the money and no prospects of seeing it anytime soon.

Can anyone offer any words of advice or another avenue to follow please.
My question may be simple...but please don't assume that I am :wink:

    Then you'll have to accept this fact at face value. Little you can do at the current time.

    You could try a private detective to see if the person has other assets, you could attempt to make them bankrupt(it might be they don't have any equity though) or you could just wait until they do sell.
