Equita notice of enforcement

Hi Guys,
I have just received a Notice of Enforcement from Equita saying that I owe Leeds City Council £500 in unpaid council tax. I went bankrupt last June. Up until then this property had been let out through a charitable housing company on my behalf and they paid all council tax. The property was included in my bankruptcy and has since been repossessed and sold (although it took a few months for Northern Rock to officially take possession). What do I do? Am I responsible for paying this? I would have thought that this should be included in the BR. I have read something about if it falls in the same financial year as the BR that it should be included so was wondering if this counts for me?

Any assistance would be greatly appreciated,

    I guess the first thing to clarify is which financial year the demand is for. If it for 2014/15 then you should not be liable as it would have fallen into your BR but if the demand is for this financial year 2015/16 then it depends when was the house sold? Until you know what period the bill is for, it's hard to answer.
  • Thanks for your response. I am aware that the property was sold in January of this year by the mortgage company, so the demand is for the tax year 2014/15. Hopefully that means I have nothing to pay. Should I contact Leeds City Council myself or should I sent the letter from Equita on to the OR and leave it at that?

    Equita will act only under instruction of their client, the council, so it's best to contact them to discuss the matter to find out exactly what has happened.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
