PPI on a DRO'd Studio Account

Hello,

I am a little confused after a letter from Studio Cards about PPI on an account that was covered in my DRO which I had August 2009 to August 2010.

They sent me a letter with a questionnaire to see if I was eligible to claim back the PPI. I googled it and found a similar post on here that said that it was worth filling in so I did.

They have found that I am eligible to have £45.24 back, however they want to credit it on to my account (that was covered in the DRO and closed. I have no other Studio account.)

Is this right?! Fair play to them if it is, I did owe them the money in the first place :) But if not I'll give them a ring.

    If its anything live bankruptcy and IVAs the creditor has a right of offset, in which case you'd receive nothing, no harm in asking them though

    The debt no longer exists and so the money should come to you.

    As a DRO has no Trustee, then any money due back after discharge should go to the debtor. They cannot offset it either, as following the end of the moratorium period they have no legal method of recovery, i.e. the debt no longer exists.

    For the amount you have to ask is it worth it, but it is yours so I would be sending them a strong letter, at the very least, quoting relevant insolvency legislation.

  • After Barclaycard informed me they would be offsetting some of my PPI payment, they then informed me the Official Receiver had told them the insolvency was a DRO and not a Bankruptcy and so they were to return all the money to me.

    Be sure your lender understands the insolvency was dealt with under a DRO and not bankruptcy and so they are to return all the money to you.

    Thank you. I'm sending the letter off today.

    Bit delayed as had a relative rushed into hospital at the end of the last week. Thankfully he was discharged last night so we're just catching up on everything.
