How to set aside a CCJ from ParkingEye?

I got refused credit after applying for an american express card... I then found this wonderful free site "noddle" to check your credit report for free so I signed up.

Upon checking my record, I discovered a CCJ had been filed against me on the 5th August 2014. It's been filed against my previous address and is for a sum of £185.

I rang the court to find out which company had filed the claim to find it's a company called "ParkingEye Car Park Solutions". I then rang ParkingEye to find out about the charge which they say was for a parking infringement at 18:24 on 18th April 2014 at the Beehive Centre in Cambridge.

I never received anything from ParkingEye regarding the charge; If I had, I'd have probably just paid it and be done with it.


I moved house on June 27th 2014, and subsequently did not receive any paperwork from the court informing me a claim had been filed against me. Obviously, I didn't attend court and the judgement was filed by default in favour of ParkingEye.


I have letters from my solicitor proving the dates I moved house (completion statement). I have a copy of my credit report obtained today indicating when I became aware of the filed claim.


Now I'm quite happy to pay the £155 fee to apply to have the claim set aside, but I'm missing one vital part; what valid defence can I mention (i.e. relate to a similar case) as a solid grounds I would have defended the original claim?

    If defending it is too much for you Parking Eye often agree to a set aside if you agree to pay what they think you owe them.

    If you are up for fighting it then the basis of their charges are being taken to the Supreme Court. Check out the Parking Pranksters guide for more information.

    If the parking 'crime' was on 18th April 2014 then Parking Eye would have sent you a Notice To Keeper sometime before 3rd May 2014. If they did not then that is reason enough for the seaside as they have no prospect of winning a case against you as Registered Keeper of the vehicle but must pursue the driver whose identity they don't know unless you tell them.

    Did you really get no letters from PE in the 2 months after the 'crime' but before you moved?
