She also mentioned that there is a fee of £550 involved that the DCA will need to pay the FOS.
.
Yes, this is the referral fee companies have to pay the FOS, if they receive more than a certain amount of complaints in any financial year.
That is why its always a good idea to refer your complaint to the FOS as you are costing the company causing you the problem, money, just by filling in the form.
Tends to focus there minds somewhat, hope you get a result !!I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. I have a question regarding the FOS service and my complaint.
This is likely to cost the DCA £550 - I'm assuming the person on the phone at the FOS had some data on the screen to show that this company were past the 25 free complaint threshold (hopefully I've interpreted the information of found correctly and each company get 25 free complaints each year before they have to pay).
At which stage is this matter likely to get resolved? The person I spoke to at the FOS advised that I would need to send all the documentation to them for analysis and the DCA are also required to send their file too. The adjudicator would look at the evidence and make a decision.
I would imagine that they'd rather not pay the £550 because facts are facts, and I am not the right person that the debt belongs to.
At which stage does the £550 become payable? Can they simply acknowledge my innocence in the matter and agree to leave me alone?0 -

Each side presents the evidence they have, the FOS Will look at it, and decide, on balance, if you have been treated fairly.
Once a complaint is received, it will run its course, there is no "quick addmition of innocence" track to take, although you may find they will fess up and say you are not the person they are looking for, or, they may not.

Received my FOS form yesterday and returned it. The person on the phone at the FOS mentioned the DCA would need to submit their file on 'me'. Am I entitled to a copy of this too?0

If its relevant, the FOS will refer to it in its findings, the only way for you to know what information the DCA holds on you, is if you do a SAR (subject access request) to them, at a cost of £10.
That will get you everything they hold on you.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. All the best mate hope it all goes your way
Just as a side note can you claim anything from them ie: so sort of compo due to the fact this has all cost you time affort and money just to prove to them that they are wrong“People are caught up in an egotistic artificial rat race to display a false image to society. We want the biggest house, fanciest car, and we don't mind paying the sky high mortgage to put up that show. We sacrifice our biggest assets our health and time, We feel happy when we see people look up to us and see how successful we are”
