    I'm assuming then its definitely not possible to average those 28 days holiday pay over 52 weeks to arrive at the same wage each week as that is how we would actually prefer to do it.


    I was hoping there might be a clause that would allow this for family situations/members or simply for an employee & employer who both wanted that.


    I can't quite understand why its not allowed under those circumstances?

    Look. I think you have been reassured now but to repeat .....

    You are paid a wage/salary of £XXX per week. It is the same whether you are working or on holiday.

    It is not a case of paying you so much for working and so much extra for holiday. It's all part of the total pay you receive.

    As your step son has 28 days respite care it seems to me that this is exactly to cover the minimum statutory holiday entitlement. It's actually been designed so that you should take your holiday entitlement at the time he has the respite care.
