Thank you for your replies, the way holiday works is essentially, you gain a day every two weeks, but you must have worked those two weeks first to gain a day.

So when it comes into the final holiday period, it is pretty black and white by the agency that if not taken, hard luck you will lose them.

The only issue I have is that this only really allows for the odd day off near the end of the agencies stated year end date rather than allowing an actual extended period of time.

I would much prefer to try and take a full week off but can also appreciate the difficult position it puts my place of employment in.

Again, thank you for your replies, it is nice to hear other perspectives on the matter.

Presumably on this basis, no one from the agency (apart from possibly those who have started within the last 2 weeks of the agency's holiday year) works on the last day of the agency's holiday year?

Thank you for your reply Podge,

I have broken it down into the simpliest of terms in regards to the holiday. Which the other agency staff who have been there longer than me have all accepted and never questioned.

It is quite annoying that although I have been with the company well over one year, this is the way that holiday is calculated,.As you can imagine, it is hard to take extended periods of time near the beginning of the new holiday year, as you have not worked enough weeks to be entited to the time off. And also makes things difficult near the end of the year due to the amount of work at this time.

Aquamania, yes numerous holidays of a day or so are taken by the agency staff at the end of the entitlement to ensure they are not lost although it is quite difficult and I did end of losing days at the end of last year which is the main reason behind asking this question.

I DON'T WANT IT TO HAPPEN AGAIN!!! :)

Thank you to anamenottaken. I will be asking both the agency and my employer if this would be possible.

Also specialboy & anamenottaken, you both mention this 1.6 weeks, would you be able to elaborate further on this for me please?

Total statutory entitlement is to 5.6 weeks. When the legislation was first enacted it was 3 weeks and then increased to 4 weeks.

It is said that the legislators thought that employers would give this amount of holiday and also bank/public holidays in addition. However the legislation didn't say that and so many employers were including those holidays in the 4 week entitlement. Thus 1.6 weeks was added - to cover the 8 public/bank holidays.

When the rules about not being able to carry over holiday was introduced, the entitlement was to 3 rising to 4 weeks. The extra 1.6 weeks has not been included in the provision not to carry over and therefore this amount of leave can be carried to the next year if both employer and employee agree.
