I'm confused why someone would want to exercise their rights under the Act if not to avoid paying back money that they duly owe.
Im speaking as someone who has been in debt but worked hard and went without things to make sure I paid back every penny I owed.
Dont get me wrong, i think its admirable you feel obligated to repay what you owe, but I know from personal experience, how debt can affect peoples health and well being.
I think if you are in a situation where debt is ruining your life, then you should use any and all methods you can to become free of it.
If that includes having some accounts rendered unenforceable, then so be it, I have no problem with that at all, of course if you had read the complete thread, you would of seen the OP wishes to settle this account, and he is going about it the correct way, as advised by this forum.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. When negotiating or evaluating your positions you need to know what cards you and they hold. Simply that. dobbollah is considering a 25% or reduced offer which is a perfectly legitimate thing to do for any debt.
Also not very nice to make presumptions and judge.Still rolling rolling rolling......<

well they politely declined the 25% offer without making a counter offer, suggesting I call if I wish to make an increased offer.

Does it contain the prescribed terms? Not all agreements back then were legally enforceable, even if it was a copy of what you actually signed..Still rolling rolling rolling......<
