Any advice recieved with thanks

I have recieved a letter from DL&C... they are collecting an old credit card debt... I have been paying £9 for just over 3 years. The debt is about £2,500... I have never defulted nor missed a payment. I am not in a position to increase the amount yet.

They are going to take me to court to get a charge for payment, to secure against the interest in my property??

I work 2 jobs to get out of debt and a CCJ would set me back... I need some advice please.

  • Firstly, the letter is very probably a random threat to try and panic you into paying more.

Secondly, a CCJ doesn't neccessarily mean you will be set back. The court doesn't just rubber stamp whatever a creditor asks for - it's worked out on a proportional basis depending on what you can afford. So if you can't increase what you are paying then the court will very probably find the same.

Thirdly, a charging order doesn't work like that either. A charge would only be able to be applied for if you firstly got a CCJ and then secondly you defaulted on it.
