Hello not sure if I am on the correct section to post this but please can someone advise?

looked on all the forums for advice at the time and was told by nearly everyone to completely ignore any letters that they would send and was shown the order in which they would come and so they did ~ like the first being the Parking notice then the Roxburghe Debt Collectors letter dated April 2012 for £132.00 each letter then the Graham White Solicitors dated April 2012 adding on costs making it now to £207.25 each letter then a Final Warning from Graham White Solicitors dated April 2012 stating £132.00 each letter and each time I was told to ignore them and not to contact them at all but today May 2015 I have received two letters from Rossendales Collect telling me that £30.00 has been added to the original balance making it £100.00 (each letter) and that they were pleased to inform me that their client has agreed to a substantial discount of the outstanding balance if the settlement figure was paid within 14 days, the usual red bold lettering underneath with their phone number etc.
So after ignoring them all this time I now don’t know what to do. I am a pensioner and cannot afford this amount and was wondering if I should have paid up in the very beginning rather than have all this worry now after all this time. They have never phoned me or us contacted them so what should I do now as it seems that the advice is different now since 2011.

Anyone else in the same boat? Would appreciate some help here please it seems so complicated now.

Thanks worried Granny

this was 2011 well before the new changes in law came in (POFa 2012) , did you at any point contact the parking company / appeal etc or have you ignored all the junk mail?

as this is before 2012 , they can only chase the the driver , however if you have not spoken to them and named yourself , thing are awkward for them.

lots of names from the past

    Roxburghe Debt Collectors

    Graham White Solicitors

now at least one of those has had its licence revoked ,

also please remember that Rossendale "collect" are different to Rossendale bailiffs , but they often put the wrong paper in the printer!

they (collect) are simply debt collectors , cannot take you to court , cannot knock on your door , cannot kidnap your cat.

some would say , send a "get *&^%*("" letter to them , others say forget about them ,

if they are dropping the price , that means that they have "xxx" [edited] the alleged debt , and are now trying to x10 there payment fee

DO NOT ring , write or email rossendales , they are not there to help you , they just want money

Thanks for your reply ~ no we did nothing at all no phones calls no letters to them just completely ignored them but don't like these last two letters that came today my husband is worrying and think maybe we should pay them as the amounts are lower than what they were but it's knowing what will happen next.
    Thankyou

no , hold on for more help , the more letters they send , the more they worry you , that's there idea.

rossendales cannot take you to court , only the company that ticketed or there solicitor's , rossendales will threaten "may" "suggest" etc etc , but the moment they do that , they wont get a penny (they wont anyway!)

It's a last ditch attempt to intimidate you into paying. Look, if anything 'serious' was to have come out of this it would have been done a long time ago.

You may have to endure a couple of further letters (who knows for sure?) - but the end of the tunnel is getting ever closer.

I doubt the 'debt' has been sold; it only has the status of an alleged 'debt', and in any case the PPC would have had to have informed you of the assignment to another outfit.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

A "substantial discount" huh? That's nice! Why do you think they are offering that? (Hint: perhaps it's because they know they haven't got a leg to stand on and they're desperately hoping you'll take the bribe).

Keep ignoring and enjoy a discount of 100%. The law changed in 2012 but the change wasn't retrospective i.e. the advice to ignore in 2011 is still valid now for these two fake fines.

    Hello

In the same position as the first poster - or rather the Mrs is!!

Thought I would look to see if they are up to their scams with others - looks like they are.

I agree with those who have replied. Law cannot be changed retrospectively.

    Hi Chrisywilly
So how far are you along with all this? we are a bit concerned about these last 2 letters but it seems from what everyone said back in 2011/12 you either paid up if you couldnt hack it or stick it out by ignoring them so we have done that untill now. After reading up on all the forums again it seems more complicated and new to me so if thats what the advice is then we just carry on doing nothing!
    Thanks :)

Known in the debt collection business as "Zombie debt" Excel have passed on a list of previous ignorer's who the debt collector will try to scare into paying, if they get nowt Excel have lost nowt, if they get anything the debt collector takes their commission, and Excel get something.

Excel wont even waste the price of a stamp on trying it on, so the chance of them pursuing any further then letting a debt collector have a pop is not impossible, but the chances are very slim.

I am in exactly the same position as Mabinogion - came as a bolt from the blue offering a discount! I actually rang them as I thought it was a recent PCN and they had the wrong person as I had sold my car last year.
Was astounded when she said the didn't know when the alleged contravention was but the warrant was issued Aug 2011! I went through the similar process back then, letters from whites etc. I had completely forgotten about it until the letter arrived today. 6 years ago! They say in there letter that the balance remains due in accordance with the Limitation Act 1980 which allows up to six years for recovery of the outstanding amount! I am sure the limitation Act does not relate to recover of parking fines - i'll have to look this up. As with Mabinogion I was then worried however I have been comforted by reading this thread. Thank you for all the sensible replies here it is good to know there is somewhere to turn to for advice and help.
    Many Thanks
