CCJ and inheritance

Hi hope someone can help, my husband has a CCJ in his name he pays a regular amount each month as agreed. I am due to receive an inheritance can the company collecting his debt take my money to pay off his debt.

No, but you could of cause get him out of his mess by giving him the money to pay it off as will be cheaper in the long run.0

Keep pedalling; why would it be cheaper in the long run ? The amount to pay is set at the time the ccj is issued, there is no cost saving involved in paying the ccj early.0

No,
debts don't transfer between husband and wife, it's his debt, only he can be liable for it.

Hi thanks for your help, if the CCJ sets the amount to be repaid each month can the debt collection agency ask for an increase all the time, he is on benefits and so doesn't get pay rises and such like, in fact he has had his benefit cut.0

Hi jem
If the court has set the payment rate and he is keeping to it, there is nothing more that he needs to do. The creditor would have to apply to court to request an increase in the rate of payment, rather than asking him directly.
Equally, if your partner is finding it difficult to maintain his current payments due to benefit cuts, he can apply to the court for a "variation" of his own to bring them down to a more affordable level. We have a fact sheet that explains how to do this:
