Help me understand please!

Hi All,

Just a quick question on behalf of my wife. She is a part time worker and job shares with another lady. They both work 4 days a week and cover each others days off. Now my wife has a Friday off and her colleague a Wednesday off. The job is based in an office in a school and every so often the school is closed on Friday as the day is tagged on to the half term, INSET etc so my wife feels she misses out as her colleague will occasionally be getting 2 days off in a week (Wednesday and Friday). Is this just tough luck for my wife, or should she be given an additional day.

I honestly haven't a clue!

    I was going to say it was tough luck, but I'm not so sure. Your wife does not usually work Fridays, and so I don't see the issue whether the Friday is an inset day or not.

    Also most staff still work(train) on school inset days ... it's just the kids who have the day off.

    As you say your wife and the other employee concerned cover each others abscence, presumably both are only paid for the days they work. If anything, the other employee is losing days (if there is no work on inset day).
    Presumably from what you say, they can negotiate between themselves if they want a day off within reason (as long as it's not on the same school day) ... and the pay they each recieve will reflect this.

    Just for info the office/admin staff aren't required to attend the INSET days so they are all off work and it would be classed as holiday. Really not sure about the pay issue and if anybody loses money, my wife is paid pro rata, the same amount monthly throughout the year.

    If the inset days are treated as additional holiday for office/admin staff then they should be added to their annual leave allowance. For those who would normally work on the relevant days the school can direct that they take the leave on those days, for anyone else either the school can say which other day they take off or the employee should book them off as with any other leave. I believe your wife is missing out because of her working days schedule at the moment.

    What does your wife's contract of employment say about holidays? How many is she entitled to?
    As long as these are granted, then I don't see the issue.

    Some employers, especially like schools for example, dictate when some or all of those holidays may be taken.
    (This wouldn't affect your wife here, but would affect her co-worker if she is told to take inset days on Friday off as holiday)
