CSA - Unpaid Arrestment

My partner had been paying his CSA through a wages arrestment although we had asked to pay it through standing order. The arrestment started in 2004 and it was not until May 2005 when I had a bailif at my door that we had discovered that his work has been taking the money from his wages but had not past it to the CSA they had kept the money so basically they were stealing from a child! I phoned my partner and explained the situation to him he went into his work and asked them what was going on, they fobbed him off by saying they just hadnt passed it all on. My partner then started to realise his work was in trouble as they kept paying people off and then in June 2006 they went into insolvency. When the company went into insolvency I took it upon myself to phone the CSA and find out was happening, I spoke to this grump of a woman who told me they could not speak to me as my name was not on file which it was as I had spoke to them previously. I phoned again and spoke to a nice man who told me to they had received no money since May 2005 although it was still being taken from my partners wages, I was advised to send in his payslips and they would deal with it. We received the payslips back with a receipt and nothing else. I phoned again and spoke to my now case worker I explained the situation again and she told me that I would have to send the payslips in again as they had "misplaced them". It took until March of this year for the CSA to get a claim form from the liquidators which I have since found out has the wrong dates and the insolvency service are saying the cannot pay out. The CSA have now told us that we have to pay this money to them again even though its already been paid. Our payments are going up to £153 a week to cover this. My partner and I have two children of our own and cannot afford to pay this amount every week. Has anyone else been in this situation????

Unfortunately lsot paperwork is really common. They lost ours between Friday and Monday, on the Friday they confirmed that they had all the paperwork they needed and by 10am on Monday morning it was all gone :eek:

My only advice is to fax everything if you can and keep copies. A letter according to the CSA can take 14 days to get onto the right desk, a fax only takes two. This is because the post is not opened onsite.

Do you have copies of the payslips? Also can you not get the CSA to fill out a new form. I would almost certainly think that you are eligible for compensation on this one! Unfortunately the assesment will stand until it is sorted out, unless you can produce all of the paperwork again very quickly.

lost payslips doesn't surprise me - CSA lost my partner's signed agreement for visitation. God I hate the organization.
