Statute barred

My child maintenance claim goes back to 2001/2. Finally csa have a charge on exes property and he has to pay a large back payment. I know that from 2008 I can keep any money payed. Will the local council apply for me to pay back housing benefit for the period before 2008? As it's over 6 years would this come under statute barred? Any advice would be gratefully received. Thanks in advance.

No you wouldn't have to pay back housing benefit. You don't owe the council a debt so statue barred is irrelevant.
Child Maintenance is ignored for benefits so it wont affect claims going forward - unless you have over £6k in savings.
I wouldnt hold your breath that you will get any money any time soon tho... a charge can be sat there for years and years!0 -
Thanks for your reply. A person I talked to at CAB said shed found a case where a mother had to pay back any payments that would of been made before 2008 as the old rule applied. So this could happen in that instance. I know they can't touch it after 2008 but am worried about before..0

I am almost certain that the lady from the CAB is talking complete and utter tosh. I tell you why.. I got over £10k lump sum in 2004 and not a single penny of it needed to be paid back to Housing Benefit or Income Support (which I claimed 1998 - 2001).0
