Hi, I put a number of s78 requests last month and am waiting on a lot of replies - however I spoke to Lloyds today (my biggest creditor with about £50k of debt), and put a complaint in regarding the date of default against the unsecured loan I took out with them in 2004.
I ran in to trouble in April 2007 and entered a DMP with CCCS in June, 1st payment July 2007. Anyways the Lloyds loan I had was not defaulted until late 2010. I spoke to their complaints department who advised they need a day or two to look into it. She also advised she would look into the current account and credit card I had with them.
To cut a long story short they agreed that the default date was incorrectly applied too long after the actual default, and so will be revised to 2007 - meaning it will drop off my credit file. On top of that she advised £36 of interest will be credited back to the c/c account, £512 interest from the loan a/c, and £1543 interest credited against the o/d a/c (which has been sold to a DCA and so I may be able to negotiate a lower settlement figure).
Barclaycard are going to come back to me in the next 5 days, regarding the default date being incorrect too. Fingers crossed - as these 2 creditors are the only negatives that appear on my CRA listings.
