Its the first time i have posted on the site, i have just been on a dmp with payplan for two months now. Can anyone tell me when a creditor phones you in the evening are they required to ask you your date of birth etc, and mothers maiden name and stuff like that. Also should they tell if the call is being recorded.
The reason i ask i have had morgan stanley swearing at me down the phone and northern rock bieing abusive towards me and they never ask any security questions when they first start the call. I always tell them i am with payplan but they are totally out of order the way they conduct themselves on the phone.

They are being completely out or order - there are template letters to request that they only communicate with you in writing, and pointing out that continuing to telephone will constitute harrassment. I'll try to find them for you.
As for breach of data protection - if they're not even bothering with basic identity checks then I would think you've got grounds for a complaint, not sure to who though...
Keep a note of all the phone calls you receive from them with date, time & any specifics such as swearing, threats & whether they confirmed your identity.
Might be worth checking with PayPlan as well if they agreed to the DMP - if they did then any further contact from them is pure harrassment IMHO.Total Debt 13th Sept 2006 (exc student loan): £6240.06 :eek:

I am writing to express my serious concerns regarding the telephone calls that I have received from your company.
I am now formally requesting that all further correspondence be made in writing only.
I demand that these phone calls stop immediately. I am familiar with the terms of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1970 and I believe your harassment places you in breach of these acts.
If you continue to call, you will also be in breach of the Wireless Telegraphy Act (1949) and, as such, I will report you to both Trading Standards and The Office of Fair Trading.
Take further note that continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.
You will be deemed to have been served notice of my request and I will deem it served by (FULL DATE), I am advising you that any calls received after this date will be recorded with the intention of them being used as evidence.

The next time they call, you could always use the line, as soon as they say who they are
"For quality purposes, this call may be recorded" and have a tape recorder ready. It'll be interesting to see how they react then.I am the leading lady in the movie of my life

Hi Stumpy and welcome
What happening to you isn't unusual, I've heard people mention in the past getting a dictaphone (or even pretending) and announcing before confirming who you are that you are recording the conversation. Also don't feel obliged to accept the calls, I'm with CCCS and initially plagued with calls. I have caller display and simply stopped answering calls from numbers I didn't know and witheld numbers - letting the machine take a message - often they just hang up. Hope that helps.

Or get a whistle loud pe or train station one and when they start whistle down the phone loudly!0
