Marston bailiffs clamped my car on the drive 😟

At 6.18 yesterday morning a bailiff from Marstons clamped my car on the drive and demanded £422 to release it for payment of a parking fine of £112 which I had already paid to the council. I had challenged the fine with the council but they sent Marstons round so I paid it. I don't have evidence of court proceedings. I needed my car to get to work so had to put the fee on my dad's credit card but will need to pay it off. I'm on an IVA and don't have any extra disposable income for stuff like this. Feel so powerless against bullying tactics when I'm doing my level best to get debt free:(

    You say you already paid the £112? Prove you paid it and claim the money back.

    Or had it already been passed to Marstons then when they tried to collect the new amount of £422 you paid the original £112?

    £422 would be the original parking penalty of £112 plus £310 in bailiff fees (£75 "compliance" and £235 "enforcement"). If you paid the penalty twice over (PLUS the bailiff fees) you should certainly endeavour to get the overpayment back.


    As forgotmyname says, though, if the debt had already been passed to Marstons by the time you paid the council, they will have been entitled to add their charges.

  • The bailiff said it didn't matter I had paid the council already, I had to pay him and claim it back off the council even though I had a receipt from the council to say it was paid.
