What to do if a creditor cannot supply CCAs

    thanks for all the help so far.....

    so if they dont answer, i chase, and then give it a couple of weeks and chase again.....at what point do i say stop....and refuse to pay.

    or perhaps offer to pay something on the condition they set good my credit record or is that highly unlikely

    You can stop paying whenever you like, personally, I'd give them chance to send it. Say a month.

    You could offer to pay based on credit file removal. Unlikely, but, possible if they admit they have no agreement.

    ultimately as we all do, i just want rid as soon as......

    it seems to good to be true that if they cant supply the CCA stuff then I should draw a line and say i'm not paying and that be the end of it....id want some sort of closure as i just want this to end so i can move on with life

    If you stopped paying, it would not be the end as they/other DCAs will continue to chase it. If they cant provide a CCA or its a non compliant one, you can likely use that to negotiate a significant discount on a full and final settlement.

    I've got a voicemail message from one ot he creditors requesting I call them about my the CCA request.....do I ignore them....?

    If they call back whats the best approach, refuse to discuss and ask them to put it in writing..?

    this creditor relates to a former current account so would comprise of overdraft and fees, I was since told that the CCA request doesnt apply to this anyway...?

    I would tell them to put it in writing.

    You are correct in that the CCA on an overdraft doesn't apply.

    You should think about complaining to try and get the balance reduced if made up of mostly fees and charges, especially if they just let them build up rather than terminating the account.

    if they call i'll ask them to put whatever they say in writing....thank you

    its not a large amount of money - £480 or something (they get about £4 a month!) and as they have defaulted me which expires next dec I'll just let run for now and focus my attention on much bigger balances.

    worth a complaint if its all charges. How long a period did they build up?

    It will only take a letter and an FOS referral if they refuse and could get you some of it back.

    You wouldn't be claiming that the fees are unfair, simply that once they realised you had no intention/way of paying they should have closed your account to stop the fees building up for their benefit.

    yes thats the one....i guess id need to see a full statement of charges before i knew what the amount fully comprised of.

    A SAR would get that if you don't have any statements. Cost a tenner mind...

    Or, just complain and let them provide the details.
