CCJ reapeared

Hi I was given a loan by lloyds which I could clearly not afford, I had mortgage defaults I had maxed out on overdraft and had other loan defaults, in 2001 I was invited into lloyds to as they said help my situation, they consolidated all my loans and overdrafts into one loan which ended up being £10,500 approx, I was working full time at the time earning approx £800 per month.
As expected we could not afford the repayments as it was like paying two mortgages with my house mortgage as well, my wife was only working part time, to cut along story short,I was issued with a CCJ in 2004, after we went to a debt councerlor we agreed to pay £40 per month, which we did till 2011, on checking our credit report we noticed the debt said settled, we stopped the standing order as we thought the dept had finished, we had no further contact although we lived at the same address for a further 3 years, we moved to a new address last year.
I received a letter saying moor croft debt collection needed to speak to me, I had no idea what this could be about, I rang them they said I owed them £7500, I said the debt had been settled, please help, I do not know where I stand.

    Hi,
    No the debt wasn't settled, this is a common misconception, you should never just assume anything where money and debt are concerned.

    It said settled, because the original creditor sold the debt to moorcroft, it can take a while before a DCA starts to chase a debt, now it appears they want paying.

    Moorcroft may not be aware of the CCJ however, as they don't often bother with the niceties of paperwork.

    Stay off the phone to them, do everything in writing, sent them the provit letter first of all, available here :

    7 years at £40 per month is £3360

    So you would expect there to still be £7140 still to pay, maybe a little more with court and solicitor costs so £7500 sounds about right.

    Sourcrates advice is spot on correct.
