    What happens if they ask you to work any extra day and send you home, BH will be no different.


    Do those that normally work a BH that don't use up a days holiday?

    Any extra day though as I see it is overtime which you are not contracted to do in the first place. This is different as you are contracted via the handbook is the way I see it....
  • TBH, I don't get the drama people make about Bank Holidays!
    Personally I'd rather work 5 BHs at time and a half and accumulate an extra weeks holiday than have 5 random Mondays off. But that's just me.
    OP even if they send you home 2 hours in, you'll have 3 hours pay and another day off. Happy days IMO :-)

    Well I can honestly say, that in the past 10 years (at least), the only BH ive had off has been Christmas Day, and then only by sheer luck. Still not sure what the fuss is!

    Pretty much the same here apart from the spring bank holiday which falls in Whitsun Week as that is usually a shutdown week.

    Not everyone gets time and a half for bank holidays that's why some dont like working them.

    I get normal pay for bank holidays and as I work Mon-Fri I do all of them.

    Some places it is normal trading hours on a bank holiday, none of this 10 till 4 or 6, but the full 13 hours of being open.

    Short answer - yes.

    You may feel this is discriminatory but it is not unlawful discrimination. It is entirely a contractual matter. Those employed before certain dates would have been offered and accepted different terms.

    As I read it, your contract is to work certain days generally not including Mondays but also to work on Bank Holidays if the firm so requires. If those are the terms you agreed to then basically you are stuck with it.

    I would agree however that they cannot expect you to turn up on a bank holiday then perhaps be sent home again with no pay.
    I know it's NOT legal to be made to work a bank holiday if your contracted day is a Monday

    That statement is simply wrong. There is nothing special or protected in employment law about bank holidays. Whether you are required to work them or not and, if so, whether you get extra pay is entirely a contractual matter.

    Finally, your "contract" is far more than simply a piece of paper with the word contract on it. It would also include staff handbooks, custom and practice and possibly even notices on the tea room wall!
