Posted on reclaiming charges board and no joy - help please!

Hi,
Posted this on the reclaiming charges board and got no joy - so I'm hoping someone on here can help!
My mum took out a LloydsTsb loan years ago, with loan protection. She later got cancer and they are refusing to pay out, as apparently she is not covered according to the terms of the protection plan. They were getting really nasty with phone calls, letters, etc because once she couldn't work she couldn't pay. She was a nurse, so this is currently being dealt with by the RCN, who are trying to get them to pay out
Anyway, they have been taking the loan money from her account, thereby sending her into an unauthorised overdraft, then charging her for the privilege of being overdrawn.
My question is, can I make a start on reclaiming these charges while they are still arguing about whether or not the loan insurance pays up?
I am so furious they were harassing her when she has got a diagnosis of terminal cancer :mad: . B*stards.

I am so sorry to hear about your Mum. I'm not sure about the answer to your question, but someone will be along soon who will be able to help I'm sure.
I guess you would be able to claim now, but it might be better to leave it until everything is sorted so that you reclaim everything. I know some bank write in a clause that states you can only reclaim once.

Can you get the bank to refuse to let the money be taken - claim it's in dispute or something?
Perhaps set up a new bank account seperately for her money to go into - if she gets any benefits etc and bills to come out of and keep it seperate from the whole loan/ overdraft argument so she can see exactly how much money she has/hasn't got at any one time and once you have sorted the loan out you can pay off the overdraft?Making my money go further with MSE :j

It gets more complicated as we currently live in Spain: her illness was diagnosed here and all her treatment has been carried out here.
Debts are in UK because that's where my mum used to work (we're British, but expatriated). There's no intention of defaulting, but my argument is as they sold her the insurance in the first place, they should bl**dy well pay up!
My mum is hopeless with money - I used to give her money to pay her household bills, but she was never sure what was due when and I was constantly opening final reminder letters. In the end I got sick of it and switched everything to my account. She's a brilliant nurse but hopeless at finance

Is her current account with Lloyds TSB also? Because if so, this may explain why they are taking the money from her account regardless of the charges....I had this with my Natwest loan my current account, in that they took the money even when I was off sick or out of work.0
