Ridiculous charges and deep trouble

Hello

I am hoping for some advice. Please don't judge me I need to know if there is anything I can do.

Very stupidly I got a varooma loan on my car last year. All was well for a period of time and then a payment was missed (November last year) and I was whacked with massive charges and the car was taken. I paid through the nose to get it back.

Earlier this year I was very mentally unwell, something that had been rumbling for a while since a miscarriage, a loss of a relationship and a close family member dying in the space of 3 days back in 2013. Anyway the depression a came back with a vengeance, my anti depressants were increased and I had to seek more therapy. I was off work for about a month.

Needless to say things got on top of me again and I missed payment in March and April this year.

I bit the bullet and wrote to them detailing my situation that I was unwell and I was trying to get back on track. I was back at work and the depression was under control.

The car was already "out for collection" but I entered into an email conversation with them asking to rejig my payments and expressing that I was not in a position to pay anything til this pay day. (Thursday coming). They asked me to fill in a form about my in comings and outgoings which I duly did with my proposal. This was accepted last week. A £455 payment to be made on Thursday and going forward £210 a month. All of which I could afford.

They said that this was acctable but said that they could not cancel the collection of the vehicle if it got collected in the meantime.

Sadly for me (3 days til this would have been sorted). I w as awoken this morning by an enforcement agen repeatedly buzzing my intercom at 5.45. Obviously dazed and confused I let him in. I explained that I had lots of email conversations with varooma detailing the whole plan but this was to no avail.

My other half went out with him to the car (which we had hidden but it still got found) to take things out the car and magically it seemed that 2 tyres had been let down!! Never, mind! the enforcement agent was quick to pump them back up again. Am sure he let them down anyway!

I have now spoken to varooma and to get my car back they want the full arrears and extortionate charges ( and yes I am week aware that they are all in their term s and conditions.

The full arrears are over £2k. The original loan was £2k and obviously I've made atleast 8 payments too. Plus they are saying that that just covers the arrears to get the car back..... It doesn't even touch the outstanding balance.

I do it know what to do, to add to all of this I am pregnant and this has made me throw up all morning from the stress and I have called in sick to work.

It's all my fault but do I just cut my losses and let them keep the car or fight it. I don't have much energy to be honest and maybe I should just roll over?

    Sorry to hear about what you are having to deal with gemstar.

    Firstly you are not going to be judged here. Many of us have done stupid things in the past.

    I can advis e on your situation but please take some time and try to look after yourself especially being pregnant.

    I'm sure some clever person will be along later to help.

    If they keep the car are you now free from payments?

    sorry unclear on advice, but maybe cutting your losses would be better than fighting to get something so costly back.

    Thanks for the reply. I am sure the car will be auctioned at a loss and so while it might clear the arrears there will be more to pay so won't be free from payments.

    It's only a KA, it's not exactly a rolls Royce, but she was my first car and I love her .

  • I don't know if this will help or not, but my husband and I managed to get a cheap run about for £500. It came with a few months car tax and so far has been a good car
    (we've had her over two years now and no problems).
    Debt as of March 2018, £794 rent arrears £4273.7 debt, £900.70 in pay day loans, total £5968.40 :eek:. Total debt today £5968.40

  • I agree, in your situation I'd cut my losses. You can get a cheap car later when you're back on track. The baby and your mental health comes first.

    Cut your losses and buy an old Golf as they go on for ever. Looking after yourself and the baby is far more important than worrying about the car.

    I agree with the others here, I would cut your losses and let the car go. You can pick up a cheap run about in the future. You need to look after yourself at the moment :)

    The sad thing is, an hour or so after I posted this I started bleeding. I'm devastated. I'm currently at the local hospital. I've seen a nurse and just waiting to be called through.
    This is potentially my third miscarriage and has made for a !!!! day xx

    Unfortunatly the OP won't be able to just "cut there losses" as the car will be auctioned, if the charges are not paid, auction price will not be brilliant, and she will still be liable for the payments as per the original contract, so will still have an outstanding debt regardless.

    This is going to cost you money either way, so you need to decide if the car is worth your while keeping or not.
