NRP given overpayment back!

Apparently my ex should not have paid for my son for the last 6 months since he turned 18.I believed i was still entitled to it as he had accrued arrears over the years,plus i was issued in October a years plan of what to expect and when re future payments.I only found that he had stopped paying by contacting them to say i hadnt received a payment.I had no notification,nothing! I wrote to them asking why i hadnt been given notice of when it was to be taken into affect etc but they just say it was my duty to inform them,and oh by the way we have reimbursed him the overpayments and now you owe us!!! Perhaps if they could have informed me it was stopping i would not be in this pickle,especially since they gave me the forecast for another year! I am in no position whatsoever to pay a penny as we survived on his allowance.
What i need to know is can they make me repay it when im in financial hardship? I dont claim benefits and believe as parents we are responsible for our son,not everyone else.

Is your son still in education?
Why don't you claim benefits? Do you mean it's because you aren't entitled to them because you earn too much, or you didn't want to claim but you could have claimed?2025 April £257/£300

Interesting, as I thought they informed both parties when natural cessation commences.0 -
Thanks livesimply,i dont earn anything as i dont work due to disabilities.i do claim dla but wont claim anything else re esa etc as i know after working 26yrs prior to my accident i will no way be fit for work again. My son has just started uni but i dont think its classed as in education. My dla just covers my mortgage which is why the payments were important to us.0

My son claims ESA because he isn't able to work. Refusing to claim benefits that you are entitled to - and need - is very odd behaviour.0 -
You were not entitled to child support because your son is no longer a qualifying child. Child Benefit should have stopped in September when your son started university, so yes you will have to repay the overpayment. Your ex can make an arrangement to help his son financially if he chooses to, but you have no claim on him.
I presume your son is receiving student loans and grants for maintenance and tuition fees. If he is still living at home he should contribute to the cost of food and household expenses from his maintenance grant. You could claim ESA, there is probably a local advice agency that could help you to do this.0 -

But you must have known they wouldn't go on for ever? You need to go to the benefits office and sort out what you're entitled to, and give the CSA a ring and arrange a repayment plan with them. I've found most creditors are reasonable, so long as you don't keep them in the dark and ignore things.0 -
If you aren't working your son should be entitled to full loan plus probably grants etc. If he is living with you he can pay you some of this money as he would have to pay rent if he wasn't0

If you show the agency details if your financial hardship a repayment plan can be made. You have received money.you were not entitled to as your son ceased to be eligible. The agency has repaid this debt of your behalf therefore you will need to repay the agencyComp Wins 2011 : Cant wait to start listing everything:j:j:j0
