OK, you don't have to prove it, so don't. But you'd certainly be required to demonstrate it was a valid 'emergency' to a tribunal if you brought a claim when the employer sacks OH for having too much time off.

Also keep in mind that the .gov website information is a very simplified guide and certainly not a definitive statement of the law.
There are plenty of ways in which an employer could lawfully seek proof if that is what they want to do.
In this case it almost certainly doesn't count as an emergency in any case (which the law doesn't tightly define anyway). So the OP's husband was arguably actually seeking a favour from his employer rather than having a "right" to fall back on. That gives the employer even more justification for seeking proof.0 -
It was a genuine issue, why antagonise the employer by not doing a little bit of work and getting the proof.
