I'll try and cut a long story short.
Partner and I have had awful debt like most here and slowly have repaid everything back. Just as are nearly clear another debt of my partners resurfaced.
After 5 yrs of no contact Howard Cohen write demanding £6k. Partner knows this is for a loan taken out in 2009 but he can't remember who it was with and was sure the amount was less than £6k.
He writes to Howard Cohen using the template letter asking for a copy of the credit agreement. We hear nothing from HC at all.
Last week letter from the court arrives informing partner he has a CCJ.
Partner can only afford to repay £20 a week.
Just wondering if HC couldn't provide us with any paperwork what did they provide the court with. We still want to see the credit agreement and other paperwork because we have no information at all.
What does a company have to provide a court with to prove a debt?

Did he not receive the court papers ?
Or did he just ignore them ?
They would of sent them beforehand.
If they were sent to a previous address, it may be possible to get the CCJ set aside, but there is no guarantee of this, and a fee of £155.00 is payable.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
