Attachment of earnings advice

Sorry don't know if this is right place or not...

I've had 2 days from hell dealing with this and just after some advice as to if I can / should take it further?

I got my wages through on Monday and noticed they were lower than normal, after checking wage slip and speaking to payroll it turned out they had received a magistrate court attachment of earnings order for an unpaid fine (over £200). After speaking to various courts for hours the basic story is there is somebody with same first and last name as me, different middle name however but same initial and the same date of birth. (albeit a different address obviously on the other side of the country).

Somewhere along the way checks have shown me as this individual and my national insurance number has been put on to his details.

The courts have admitted it is an administrative error and will refund me (but no suggestion as to when!)

Secondarily to this I am in a job that requires declaration of all criminal conduct. After some enquiring at work they have confirmed that discipline procedures have been started as this looked to them that I had not declared a criminal conviction.

At the end of the day I am not this person and know that discipline will go nowhere and money will end up being returned but this has given me 2 days of absolute grief spending hours on the phone Monday and then hours on Tuesday dealing with the discipline side writing up a full report of what has happened etc... plus I don't know when this money is going to be returned and I am out of pocket until it is.

Any advice on should I just leave it at this or if not what to do?

    Just sort it out and be happy when its done!

    I had a similar situation that caused me a lot of grief.

    Someone born on the same day as me with the same name, but not the same middle name.

    When the records were computerised my national insurance record was linked to his, so when I got my national insurnace number, it was his.

    I paid against this number for years, got a student loan, went to uni, got a job, paid against it some more.

    This all came to light when one day I got a letter from the child support agency, opened it infront of my gf of the time...

    It was claiming that Mrs so and so was claiming I was the father of her child. (let me tell you, my jaw hit the floor!).

    Luckily it contained enough information that I could show my other half that it MUST be a mistake (age of child, and my whereaabouts at the time), that it wasnt me.

    Took me the best part of 6 months to get it sorted, over several face to face meetings, 100's of phone calls, reams of paperwork and proof in the end I got all of my records moved over, a new national insurance number, all the links between us removed (he was a bit of a wide boy).

    At the end of the day, I didnt get a sorry or a pat on the back for pushing to get it sorted, but the relief that it was over was immense.

    just push and push and push to get it sorted!

    What a complete nightmare for you. I hope you get it sorted quickly.
    I'd get your complaint in in writing as soon as possible to get things rolling.
    Your local MP might also be able to help if necessary.
    I can't comment on the compensation though.
