Marlin financial request for credit agreement

I hope you can help.

I was contacted by marlin late last year with regards to an old debt That I thought had been written off. I called them and spoke to them in December and they said they would send me a copy of the original agreement and a breakdown of what the debt consists. I then called again in February as I hadn't heard anything, to be told they were still waiting to hear from the original creditor. I've still heard nothing. They put a default on my credit file back on 2010, and it's causing my credit rating to go through the floor. I want to move into a rented house soon and am worried that this will impact it as they will no doubt do a credit check. I tried to do a credit card application as a tester and that got rejected. Im at a bit of a loss as ive asked for the details from marlin but they seem to be dragging their feet. Any advice on how to proceed?

    Hi,
    You need to make a formal written CCA request to marlin, speaking on the phone to them, never yields results.
    Just google "CCA REQUEST TEMPLATE LETTER" that is the correct way to do this.
    Stay off the phone to them.

    As regards renting, private landlords do not have any access to the financial details on your credit report, only publicly available information such as your name, address etc etc.

    You won't have any worries on that score.

    Hi,

    Thank you so much for your reply. I sent off the letter with the postal order, let's see if I get anywhere. Just a point on the renting credit check. I would like to go through an agency for that, they will have access to more information from my credit file wouldn't they?

    Well, I got a reply from them today, and the original creditor is unable to supply them with the agreement or statement of account. They said the agreement is now unenforceable, but the debt will not be written off. As the debt is unenforceable, is there a letter I can send them which will get the default removed from my credit file?

    No, as legal rulings in the High Court/Court of Appeal in the past say that the default can stay if it is accurate.

    Is there any way I can see if the default is accurate? it didn't appear on my credit file until 4 years after.

    No. They market up their searches to look better to landlords. They only check public records. CCJ and worse.

    Only way they will know about any of your accounts is if you tell them, or they ask to see your credit report via you, which you occasionally hear about.

    As said, just public records. Usually via the CRA, but that does not mean they see details of your accounts, or other parts of your report.

    As HB says, these services use some wording about credit reports that can make the unwary believe you can see more than they really show.

    Thank you everyone for your help, its good to know this won't stop me from moving.

    I had a letter from Marlin/Cabot today, they said they have 'requested that our head office cease credit reporting on the above account'.

    Does that mean they will contact the credit reference agencies and get the account removed, or simply they will no longer update the records?

    Could be anything, but it doesn't say removed
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    I would read that as not report the account, but it's worth checking.
