  • I have only been off work two months at present (feb 2015), condition has worsened considerably in the last few months.
    Then they could be jumping the gun IMO, unless you have had large periods of sickness in the last couple of years which they can again show they have been accommodating to.

    What is the time of recovery from the operation?
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked
  • All medical documents have been seen in previous meetings.

    Company Medical Officer is a DR.

    Only two months previous last June/July.

    Recovery time is 6-8 weeks hopefully.

    "Only" two months? Is this a cumulative issue, are they taking into account the previous absence also?

    Yes, they have added last years sickness to this latest absence and come to a figure of under 90 days in 12 months, they are saying that their budget wont allow sustain my absence.

    Given the length of your absence to date, and no prospect of return for several more months, their actions seem fair. Adjustments need to be reasonable, and the level of absence you describe is far beyond that.
