Csa help please !!!!

I haven't seen my kids for over 10 years (no fault of mine :A) I have an AOE ,(attachment of earnings) which obviously comes straight out of my wage. My children are 22 and nearly 19 ( I have stopped paying for my 22 year old son .of course) but BOTH are working and have been for a considerable length of time. They are also studying(ish) but certainly NOT in Full-time education. I know I have to pay for my child till he is 20, but he is working .

1. Do I have to still pay for him ?
2. I have definitely overpaid for my eldest son for over 3 years, can i get a refund !!??
3.Can I stop the attachment of earnings

    CM is payable where child benefit is in receipt so call the CSA and ask them to do a child benefit check.

    Why would you not have sought advice and overpaid for 3 years?

    No, you cannot stop the AEO.
  • I overpaid for 3 years for my eldest child as i did not know he was in full time employment. As I had Attachment of Earnings I just proceeded with the payments. The unfortunate irony is that I actually set up the AOE myself !!! Ah well, karma, maybe , one day? x

    I think maybe 'head in sand' syndrome as you could have easily got the CSA to check the child benefit status. Ask them to do a check now for both children, they should see what date child benefit stops and they can advise regarding any overpayment - however, be warned that they may just take the change of circumstances from when you call them, so dont delay!

    If you set the AEO up then no harm asking them if you can pay them/your ex direct. If you dont ask, you dont get.
  • In hindsight i really didn't know. I went for the ' attachment of earnings' as an easy option as I didn't want to be in debt at all.

    Anyway, I have just contacted the CSA and told them to check if child benefit is still being claimed!!! (They said they "will get back to me" !!!)

    If you have a voluntary deduction from earnings order of course you can ask for this to be changed. However another method of payment would need to be set up until your case is closed.
