Anyone heard of these? they are the people now collecting my loan with HSBC. I've written to them offering a payment plan, and included a statement of affairs, and a forecast of how long it would take me to pay off the debt. All seemed very reasonable. The only issue was that I wanted the payment plan to commence with the first payment on 1st september, which is a few weeks away yet. I also stated that I was avoiding running up big bills on the phone, and prefered records of what was agreed, so asked them to contact me in writing. I know they can do this, I've had two letters off them already. they only bought the debt three weeks ago.
so anyway they've rung four times in a week, not terrible by the standards of some of the experiences I've seen on here i know. And now they've texted me too. Now this isn't really harrasment, and to be honest I couldn't give a monkeys about them trying to call me up, i can switch the mobile off. what does bother me is the idea that if i did phone them back, I would be bullied into paying more than I can afford, of which there would be no record, and so i'm not going to put myself in that position.
but what i need to know is, am I entitled to correspond in writing, there's no law that says i have to speak to these people by phone to sort this out is there?
And should I follow up my previous letter, restating the payment plan offer, and re-itterating my wish to correspond in writing only? i want to get this sorted out, I've managed to sort out the majority of my other debts, with repayments agreed and running, and apart from one hiccup this month, i'm doing ok. these people are standing in the way of my getting a decent nights sleep at the moment.

OF COURSE you are entitled to demand that all correspondence on this matter be conducted IN WRITING ONLY.
Whilst Lowell should respect your wishes, experience here shows that they, unfortunately, WILL NOT.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

As predicted Lowell have ignored my letter, claimed I'm deliberately avoiding contacting them, and threatened to send someone round to my house.
Oh well. another letter on it's way to them, recorded delivery. Stating that one way or another I'll be making the payments I've promised to make on the dates I promised to make them. (they included a Giro slip on the bottom of the letter so i'll use that to make the first payment if they don't get their act together.) and that I will oly be contacting them in writing, since I'm not using my mobile phone, and I don't have a debit card to make payment over the phone anyway.

Are you paying by cheque? If you are photocopy the cheques keep a list of cheque numbers, date sent, date cleared in your account etc. As well of course of keeping copies of all the correspondance you send. Sounds like a battle of wills but if they do take it to court and you have all that evidence how bad will they look wasting courts time.
I remember writing to Lloyds when they accused me of not getting in contact with a huge list of dates that I had written to them it went quiet after that.0 -
no i'm paying in cash at the post office, but i do keep all receipts etc. so yeah, they're going to look silly if they try to take me to court. I just refuse to give in to bully boy tactics. I'm an intelligent adult, i've worked out what I can pay each month, and I've taken responsibility for the fact that I owe this money. I'd understand their attitude if i was actively trying to get out of paying it, but I'm not!
So i won't be giving in on this one, and with the help of this place i know my rights, so i know i don't have to give in. Cheers guys

Good for you I would be the same too and thats why they are worried - they know that unless they get you on the phone they are going to have to accept what you offer rather than them piling on the pressure.0
