Sick leave / fit note

Hi all, I was off sick from Tuesday 7th April I have been off work since but plan to return tomorrow.

My employer has said that because I have been off longer than 7 days I need a fit note. However, today is the 7th day so isn't that a case of self-certing? Surely the Easter Monday wouldn't count because I wasn't sick then and nor would I have worked.

I don't want to have to fight for a doctors appointment all day unnecessarily!

    Well if your employer says they want a fit note you would have to supply one or not be paid.

    I'm presuming the easter monday was holiday OP and you were not off sick before this?
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked

    If your 1st day of sickness was corretcly reported as 7 April then 7th day is 13th april.
    Return to work date is 14 April. No fit note required.
    But are you sure you reported your first day of sickness as being Tuesday 7 April.
    Easter Monday was Monday 6 April. If you have not stated that you were unwell on Monday 6 April then it isn't counted as you were fit for work on that day and did not attend on that day as you weren't required.
    If you were supposed to attend for work on Monday 6 April despite it being a bank holiday as you were on the rota for that day and you didnt attend because you were unwell then I t is counted and you now need a fit note.
    The key thing is what did you report as your first day of absence due to sickness.

    Why? Self certification is for 7 days, the OP is only off sick for 7 days.

    That assumes the OP is only getting statutory sick pay. If there is any element of company sick pay they can insist on what they like as a condition of paying it.

    And those conditions should be written down somewhere. OP - look in your terms and conditons sick pay manual or the managing sickness policy.

    A request for a certificate from your doctor doesn't make any sense. As others have said 7th to 13th inclusive is 7 days. All you can do is check with your employer tomorrow.

    Yes, they should.

    Sadly though the vast majority of company sick pay schemes these days are "discretionary" so that gives them a way round any written terms and conditions if they want to find one.
