Hi, used to be on here a few years ago but changed emails & cant remember old username so have reregistered.
Due to marriage break up, house repossession, old debts from before break up and then newer (5-6yrs old) debts due to having to set up/furnish etc a new home for me and the kids I am now in a lot of debt which I cannot afford to pay as due to longterm health problems I am now on benefits (ESA) for the foreseeable future.
I stopped paying anything towards my debts around 5yrs ago and have pretty much ignored letters asking for payment or Ive replied saying I am on benefits and cannot afford to pay anything.
Knew I would have to bankrupt at some point mainly due to the mortgage shortfall but have been putting it off as couldnt deal with it and life kept getting in the way. Im now pretty much ready to deal with it all, hopefully move house this year and have a total fresh start.
In February Bryan Carter Solicitors (Lowell) wrote to me threatening court action if I didnt pay. I replied that I am on benefits due to longterm illness and cannot afford to pay anything atm - I was thinking it was an empty threat as per usual.
Last month I received court forms for this debt - I did the acknowledgement of service online and also sent a CCA request to Bryan Carter & Lowells (inc postal order). This has been acknowledged and they said they will get back me in due course.
Now I need to do my court defense online and have no idea what to put as Im waiting to hear back about the CCA & if the debt is enforceable...
Can anyone advise on what to put? Thank you
