Time limit to express interest to join a company pension scheme

I recently asked the following question: https://forums.moneysavingexpert.com/discussion/5210162

I have spoken to the union about this and the representative tells me that he has asked two questions to the employer:

1) Can the pension payments be backdated?
2) Can I join the better pension scheme going forward?

With regards to question two; is it normal for companies' to reject applications to join a pension scheme going forward if an employee has not expressed interest within a certain period of time?

I did express interest on time; I am just intrigued by the second question.

    Under auto-enrolment rules an employer has to enrol employees into a pension scheme. An employer is entitled to have two or more schemes and use a different on for auto-enrolment. An employer is at liberty to choose when and whether to allow enrolling in any other pension scheme. Your employer appears to have complied with the rules and to be entitled to refuse to enrol you into the more generous scheme.

    I have gone back through my work email sent items and i have found an email dated October 2013, which reads:

    Dear payroll

    Please would you confirm that you have received my application to join the pension scheme? I sent it from an external location

    Regards

    I believe this clearly stated my intention to join the pension scheme and I believe the contributions should be backdated.

    I'm still confused why your TUPE didn't fall under 'Fair Deal' rules... What was your public sector scheme? (LGPS/PCSPS/TPS/NHS/...)
