Early retirement whilst suspended?

    I think if you are being investigated, you have a right to know the nature (if not the specifics) of the investigation?

    Not sure there is a "right" to know, at least in the early stages.

    Take the situation where someone is signed off sick and being paid by their employer and it comes to light that they are participating in a sport that is incompatible with the reported sickness reason.


    Would you tell them you were going to investigate this (immediately stops participating) or investigate, collect evidence and then inform them that a disciplinary process was being started?

    I am not sure either, but it seems in keeping with general employment law they'd have to tell you if you asked?

    your nhs employer and the nhs superannuation scheme are two completely different entities - as long as you fill the scheme criteria for early retirement ie are over 50 in the 95 scheme or are over 55 in the 98 scheme the nhs superannuation scheme are obliged to allow you to retire with appropriate actuarial reduction in your benefits - you would of course have to retire from your nhs post to access these benefits with the appropriate notice period for your post - once you have retired any employers suspension or disciplinary process disappears as you are no longer their employee so are no longer subject to any of their rules - depending on your post and the nature of the allegation you could still be subject to action by your professional body if that was applicable??
