  • Hi have you spoke to ACAS. They helped me
Hi yes we have been in touch with ACAS and that's how we have ended up where we are. Basically his employer didn't bother dealing with ACAS (as much has he hasn't bothered with anything until we lodged a claim with the ET).

1st off you cannot lodge a claim with the ET unless you speak to ACAS, they will then give you a code that you need in order to submit a claim to ET.

If this claim is a "Breach of Contract" be aware that the max award an ET can hand out is 25k.

If your claim is in excess of 25k you need to take it to a civil court.

CAB do a great deal of good work, however if you go down this route make sure your CAB advisor knows what he/she is doing.
Thanks for that, yes we have been in touch with ACAS months ago when the case was in its early days.

Claim isn't in excess of 25k, but thanks for mentioning that.

We are currently awaiting communication back from CAB, but also waiting to hear back from a solicitor also (who may be willing to take the case on a no win no fee!)

If you go down this route be very very careful you fully understand the no win no fee agreement and particularly what happens if you win but get little or no award. It is very easy in such circumstances to end up having to pay some or all of the fees yourself to the point that you would have been better of losing!
