Getting a divorce, question about loan applications

Hi

Ive seperated from my wife and divorcing. Can she take a loan out under both our names? A joint loan. I assume if she makes a joint application, she will need my signature and if she fakes it and signs on my behalf its illegal?

If she does this what steps can I take to avoid being liable for the debt.

Yes, forging your name is illegal. To avoid being liable you would have to notify the loan company, and they may require that you provide a crime reference number.

Keep an eye on your credit record (eg Noddle) to see if any new debtors appear.

So she would need my signature to get a joint loan? In this case I dont think she'll forge it.

My worry was her being able to apply for a joint loan without me knowing.

If she forged it you wouldn't know about it until you had letters in the post or phone calls.

No harm in keeping an eye on your credit file though.
  • She could do it online without signing anything.

I agree, a pair of eyes on your credit report is required.

A joint loan is exactly that. It has to be applied for and agreed to by both parties. There is no way you want a joint loan with a soon to be ex-wife.
  • Might be an idea to lodge a letter of disassociation with the CRAs.
  • Also worth getting rid of the joint bank account if you have one. That MAY also be a route to obtaining a joint loan without your prior knowledge. Online application from your current bank.
Of course you would see it pretty quickly.
