trying to clear debts before things get too bad.

Hi all,
I am new to this forum, basically i am after advice from people who clearly know more than i do.
Here is my situation, 5 years ago i lost my job and could no longer afford to pay my direct debits and credit cards, like a fool i buried my head in the sand and know i would like to rectify this as i am due to be a father in a month and do not want this hanging over me no more. I owed 2400 on a halifax credit card which was taken over by lowell portfolio 1 ltd, who also took over the phone contract bill i had at the time. I have had no correspondence with the company for either debt, and according to equifax on February 2016 it will be 6 years since the default. I am after the best way to resolve this as i am worried that they may take the matter further i.e a ccj before the 6 years is up.

Chees for any advice you may have.

    Hi,
The default date, is not nessessarily the "cause of action date", the date the time barred clock starts ticking, if that's what your getting at.

If no one has contacted you with regard to these debts, then I would not Rock the boat, I assume no CCJ's have been registered against these debts ?
Would be on your credit file if they had, I would wait until Lowell write to you, then post back for advise, the longer they take to contact you, the better chance of been SB.

Or if you really want to pay them, make them an offer of payment, simple choice really.

  • Hi thanks for the reply, yes i didnt think it was quite that simple with it disappearing, the card was taken out in 2008, defaulted 2010, and on my record there is an update in 2013. I have since moved house so they do not have my current address. There are no ccj's on my file, are they likely to issue you one or is that impossible to know?
