Seller won't take the property off the market

    Is there anything to stop councils gate keeping when a private tenant has been issued a S21?

    Is it legal for a council to refuse to consider you homeless and not up your priority banding until you receive a Possession Order from your LL?

    I have my LL saying he is going to sell the property.., because I have some physical and mental health issues, a gentleman that works for Community Mental Health has been assisting me with my housing application to the local authority. He has just come back to me and said that I won't be given a higher priority banding until they get proof of the health problems and special needs of my children (already provided but four weeks on, they seem to have disappeared) and until I receive a Possession Order.

    My LL says I will have to pay for the possession order proceedings. The Housing guy says I won't (I am on income support). Which is true? I don't know where to look for Court Charges, and I suppose there could be solicitor fees on top. Bit of a worry, will somehow have to find the money.

    UPDATE : Its ok, I've found out it is legal Shelter says

    "In many situations, if you are entitled to have a court order before you are required to leave, you won't be considered homeless until the day that bailiffs come to evict. But the council can still decide that you are 'threatened with homelessness'."
