HP Agreement NIGHTMARE

Hello all. Im looking for some help. In July I purchased a car with an HP Agreement.
Im am going to sumarise as so much has happened everyone will get bored if not
From day one there were delays in picking up the car.
The car has spent 25 weeks off the road in the 8 months of having it.
It is currently off the road due to engine failure and no less than 13 electrical faults.
Its been in a garage 6 times for many repairs and assesments.
There has been an attempt to fix the electrical faults and the car was returned back to me with more electrical faults and the one of the main electrical faults has come back
The finance company have stated to the financial ombudsman that they have repaired the car. This is a complete lie.
The finance company told me they were going to reimburse me for my garage costs and I have this in an email. they have since failed to refund me
They told me verbally in a recorded phone call that they would rescind me from my contract after the engine damage if I got a brief report done stating there was engine damage and because of all the previous and still current electrical faults it would be enough. The have since back tracked and seem to think they have got away with it.
The financial ombudsman think that it is fair for the finance company to offer me £500 compensation for a car that I paid £35,000 of which has spent 25 weeks off the road in 8 months, cost me more than £800 in bills which I was promised to be reimburst on and havent. after a manager had agreed to rescind my contract and havent. I have now asked for this to be assessed by an ombudsman rather than an ajudicator as this is shocking.
I thought the ombudsman looked at things fairly.
They said they went on the last independant inspection which of course the finance company sorted out. The reported stated engine damage, electrical faults but they picked out that he said he didnt think that these were here at the time of purchase? all this in an hour. He was never made aware of my previous complaints and faults and the very fact I had reported the oil light coming on after just a few days of ownership with a loud noise coming from engine surely would indicate a possible problem?.
How can it be fair me paying £500 a month for a car that has spent most of my ownership in the driveway or garage?? the fact that fjust after a month I started to experience electrical faults The car in its current state is worthless. I thought buying a car under hp gave you certain rights. seems my rights have been completely ignored. this potentially could ruin us.
If someone can recommend a solicitor as well as that would be great as I really need some help
Thanks all.

Good grief! What kind of car that costs thirty five grand is broken for 6 out of the 8 months you have had it?!
I agree of course, that you should have your money back - in full - as the car is a potential death trap, and it sounds like it's a total nail to be honest. But I am not sure why the finance company is responsible for giving you your money back. Surely, your contract is with the garage for the maintenance of the car, and they should be issuing the refund. I am not sure why the finance company would be giving back the money to you. I mean, they didn't even pay it to you; they paid it to the garage.
If I bought a mobile phone on my credit card, for £400, and it was useless; I would demand my money back from the store, or the manufacturer, not my credit card company.
I hope you do get a full refund. Maybe try the CAB or see if you can get a half hour session free with a solicitor. You didn't, did you? :rotfl::rotfl:0 -

Under an HP agreement the finance company is legally responsible. It took me a while to understand this. Technically until the last payment is made I do not legally own this car.
Its a Range Rover Sport. My dream was to always own one. we put our savings and everything into this. Foolishly I know.
My biggest shock is the Financial ombudsman completely missing the key points and the facts. If the finance company had the car was fixed like they told the financially ombudsman why am I driving around in a borrowed renault scenic which is worth probaly about £300 and can I just add a lot more reliable and a better car all round. Its shocking0 -
CAB got trading standards involved and they investigated the dealership. If only I had read the online reviews before purchase. I have never known a dealership to recieve the amount of complaints online as they have. The finance company made out to me in one of my first calls that they were having serious issues with the dealership regarding complaints from consumers yet THEY STILL DEAL WITH THEM?
There is a major loophole in the legal system and seems that you can sell rubbish cars and get away with it. If that statement is incorrect someone please prove me wrong as my own experience is just that0 -

My home insurance has legal cover with DAS but they dont cover contract disputes. Great legal cover that the one time I need it I cant use it0 -
Have you actually written to the dealer at any time and formally rejected the car?"There are not enough superlatives in the English language to describe a 'Princess Coronation' locomotive in full cry. We shall never see their like again". O S Nock0
-
yes i did at the start and got laughed at. I also tried to reject the car with the finance company and kept getting told I couldnt.
This has been the issue. They keep ignoring my rights.
I feel like I have no rights especially after the financial ombudsman. At the very least I expect they should be made to repair the car and compensate me. But for me I just want a full refund as the car has never been free from defeacts and constant faults. I wouldnt expect that of a car costing £3,000 let a lone what I paid.
This whole saga should simply never have gotten this far. should have been dealt with0 -
your lucky as isnt it an unregulated agreement been such high amountDon't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0
