If you pay this money, then it will be seen as an admission the debt is his, people have CCJ's set aside all the time, it isn't that rare, you appear, on the surface, to have a good case, with a reasonable chance of success, I would strongly advise you follow the legal process here, otherwise you won't see that money again.
