Debt Agency Want Money From Old Bank Account.

    I have also checked my credit file again and there is nothing on my credit file from the bank this debt came from but there is from 2014 the debt collection agency who have bought this debt.

    What does the letter from the DCA say ?

    Does it say "we have bought your debt", or does it refer to "our client"?
    I would still pursue the statute barred angle if I was you, despite what they may tell you, the onus is on them to prove its not statute barred, not on you to prove it is.

    Ah, just seen your last post, they have bought the debt, therefore the account is defenatly closed.

    I will be sending them a SB letter but will wait until they get back in touch with me.
    Was just a bit concerned that they then sent me a letter asking to confirm my details.....

  • Quick Update!

    The debt collection agency now has my home number.... How I have no idea but they are ringing me and are now sat on my credit file adding a number of defaults to my credit file.

    I held off sending a letter as I was waiting for them to contact me but I shall be sending a letter as stated above and hopefully all this mess will be sorted!

    It seems that when you closed the account, it was in dispute. If you have any record of this it could be helpful.

    You have 2 hurdles which you can put in the way of the DCA
    • Statute Barred
    • Disputed
    It requires careful footwork to work your way through this - if you play the 'disputed' card too early, you could inadvertently undermine 'statute barred'. If you play 'statute barred' you may undermine the scope to claim it was disputed.


    I think you need to be arguing along the lines of 'defendant claims this debt would be statute barred. In the event of this claim failing defendant puts claimant to strict proof of the debt against any and all disputes'


    But it needs a wiser head to check this out.
