CCJ - Help!

Can anybody give me advice?
I have had a dmp plan running with the CCCS for 4 months.
HFC Bank (Marbles & GM Card ) are refusing to accept my offers of payment.
I owe £20k approx on both cards and the dmp payment is £145 per month.
HFC have now appointed Restons (lovely people!) to recover the debt and I have had court papers.
Has anybody had experience with these people? Is therea chance it won't go to court.
If it does - what will happen on the day?
I am terrified, nobody knows the true extent of my situation. I am a single parent with a 7 year old, working all hours to sort the situation and just when things were settling down, Restons have arrived to pile the pressure.
My last post was similarly desperate and I got lots of advice, so would appeciate it once more.

The court papers have come from Northampton. I have sent the acknowledgement of service. Following the advice of the CCCS, I am defending against £3k of costs, which Restons have added to the balance.

I own my own house worth about £250k but have a mortgage of £210k and a second mortgage of £42.5k.

I did post yesterday, but I think everyone may have been out in the sun - or I am in a big trouble!!

    Who is running your DMP?

    You need to get straight on to them and send them the letter from Restons.

    Also, worth checking:

    If Restons have sent you court papers, then they are probably not court papers. Court papers can only be issued by the Court. Which court snt you the papers?

    it would not be unusual for companies to try bully tactics.

    If this is what is going on you need to file a complaint ASAp to stop this happening again.

    whats the point in having a dog if you have to bark yourself, CCCS are handling your affairs, give it to them and while your on ask for advantages / disadvantages of bankruptcy.
    good news is, you will only be asked to pay what you can afford by the County Court, quite often substantially less than the demands of your creditors, and you do not have to attend, however i would also be tempted to challenge the charges on this account, to do this you will need further advice from CCCS, if they are unable to help go to CAB.

    I suggest you draw up a complete SOA to submit to the court - you will need to show where your money is going, & that you can only afford £x, which is waht you are trying to pay.

    Just a thought, have you actually paid them the £145 pm, or not?

    And yes, get CCCS to help you - they should be advising you as to what to do to avoid CCJ's.
