CCJ Query

Can anybody give me advice?
I have had a dmp plan running with the CCCS for 4 months.
HFC Bank (Marbles & GM Card ) are refusing to accept my offers of payment.
I owe £20k approx on both cards and the dmp payment is £145 per month.
HFC have now appointed Restons (lovely people!) to recover the debt and I have had court papers.
Has anybody had experience with these people? Is therea chance it won't go to court.
If it does - what will happen on the day?
I am terrified, nobody knows the true extent of my situation. I am a single parent with a 7 year old, working all hours to sort the situation and just when things were settling down, Restons have arrived to pile the pressure.
My last post was similarly desperate and I got lots of advice, so would appeciate it once more.

The court papers have come from Northampton. I have sent the acknowledgement of service. Following the advice of the CCCS, I am defending against £3k of costs, which Restons have added to the balance.

I own my own house worth about £250k but have a mortgage of £210k and a second mortgage of £42.5k,

    I don't have any experience of the dmp or court system, but the gist of it seems to be that having set up a payment plan that you can afford a court wouldn't look favourably on a company trying to push for more. So if i were you i'd report this latest incident to cccs and ask them about it. Please try not to worry, you are being responsible and trying to get out of the mire, that can only go in your favour. Please keep posting, the lovely people on here like to help. They were all just having a bit of a lay-in today!!

  • Ok are the court papers on blue paper with Northampton County Court stamp in the right hand corner?

    If they are this is paperwork so the company can get a CCJ (county court judgment) against you.

    You do not have to go to court unless you dispute the debt which I assume you don't as you have been paying.

    You just need to complete the form with all your details and your offer of payment which should be the same as the one you send via CCCS.

    Can I ask do you own your house?

    If you don't own your house the only implications are that your credit file will be ruined for 6 years, but I expect it is already if you are in a DMP. Also the debt is not statute barred and also if you miss payments they can send the bailiff round or do an attachement to your wages of the amount the court said you should pay.
