software is 100% excluded from any warrant as it can be customised, hence the reason its so hard to ever return.
Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    Hi,
    Just thought I would update.
Dell were actually fantastic! They remotely tried to fix the computer, no joy, so sent an engineer out within 2 days, still no joy, remotely tried to fix it again twice but still no joy. As it was the one game that was messing it up, they said it was likely incompatible with the hardware (odd).
So they said that the only thing they could do now was arrange a refund, I explained that it was on credit so would that complicate issues, and they explained that it would just take a bit longer to sort out but the refund would be sorted between them and finance company. The staff I dealt with were all very polite, knowledgable and extremely helpful. It is such a shame I won't be using them for my newest PC, this time is being custom built. On the credit card for the extra protection though! lol

    Thanks all.

It may have been a number of issues. Having spoken about it more there could have been any number of problems not game related. Faulty cpu, power unit etc etc... who knows? Just glad it's sorted now.
Further it wasn't just during the game towards the end. It was happening during Web browsing and watching films.

Creation Finance say doesn't apply and I reviewed the legislation and wanted an opinion on s75a

On what grounds are they saying it doesnt apply? Would make it much easier to judge as on the surface it appears that it should.

Of course a finance provider isnt necessarily any easier to deal with than a merchant, it just gives you an alternative rather than a better option.

    Hi again,
Since I have already got this thread open I thought I would add to it.

I am still waiting for the refund from Creation, it's been nearly 2 months since Dell retrieved the computer, but not a dickie bird from Creation, yet they are still taking my money. I have sent messages requesting contact but nothing. If I cancel the direct debit, would they hit me with a charge and would I be in breach of the agreement? I'm basically paying for something I don't have...
    Thanks in advance

I wouldn't cancel the direct debit at this stage.

I would start by contacting Dell to find out whether the refund has been issued to Creation and if so on what date.

Then I would contact Creation (probably in writing) and ask them to confirm they have received the refund and to provide a statement of account and refund any monies due back to you.
A smile enriches those who receive without making poorer those who give

Sent Dell an email (CS telephone line closed only 9-5 Mon to Fri)
Creation waiting for Dell and said the same thing as you. Funny...if I owed them £500 I think they would be a bit more eager to get hold of me... lol

Still waiting... Creation say they are waiting for Dell, Dell say they have sent everything to Creation. Creation still taking money... It's been a long long time now. Have written to Creation but no response as yet.

    It's getting quite ridiculous.
