Agency workers right to equal pay after 12 weeks

Hi All
I'm curious if anyone knows who has the responsibility to pay an agency worker an equal rate to a direct employee after 12 weeks. Would the hirer expect to pay a higher rate of pay after 12 weeks or is it generally a case of the agency passing a bigger cut of what they are paid onto the agency worker?

I am guessing the agency as they bill the client but it should not matter to you as long as you get the right pay

There's usually 2 charge rates to an employer - pre 12 weeks and post 12 weeks. Once you reach the 12 week mark you should get the same hourly rate as a permanent member of staff doing the same job as you.
Depending on the job and the marketplace the 2 rates might be pretty close anyway.0 -
At my workplace we're billed a higher amount by the agency once 12 weeks passes. Hopefully they're passing that on to the worker!0

Does anyone know what happens if you are with an 'inhouse' (best way I can describe it) agency?
can they be different? I'm 2 weeks from the 12 and wonder if at that point it's simply goodbye if the rate can go up...0
