Can I return my MacBook?

Hi everyone
I recently bought a new MacBook for our new business. I have opened the packaging but not used the MacBook yet, it came from Solutions Inc who are an Apple Reseller.
A friend of mine has just called to say he can save me 28% on the cost of a new MacBook as he works for Apple - I never knew! He saw a post on Facebook and messaged me straight away!
Am I within my consumer rights to return the MacBook for a refund - they say on the receipt that it needs to be unused and unopened and it can be returned within 28 days but surely I have a cooling off period?
I know it's a little cheeky but this could save me £280 so I'd like to know where I stand.
Thanks for reading

If it isn't faulty and they state that it has to be unopened and yours isn't then I would say that you can't return it according to there own t&c's

Take a look at the information on cooling off periods here.
Then, here's some information on what doesn't apply for cooling off periods. It looks like you might be in luck!
I'm pretty sure, from reading that, that you have 7 days after receiving an online order to return it (the cooling off period). The only issue I can see is that you've opened it already. But try emailing them and asking to return it anyway, and mention that you know it's within the cooling off period, as long as it is still within those 7 days!
I did originally think it was 14 days you had though, so you might want to search for a little more information. Hope this helped though!0 -
Also you are asking about consumer rights for a business purchaseThis is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0

Business purchaseYou might not get the right to a cooling-off period if:- ·you buy certain goods and services which the law says aren't covered by a cooling-off period
- ·you're a business buyer

Did you buy the Macbook online?
If so you are in luck as you have the right to return the item within 14 days under the terms of the Consumer Contracts Regulations. These are your statutory rights and apply regardless of the terms and conditions of the seller as you are allowed to inspect the goods. It's only DVDs, Software and CDs that can't be opened.
If you bought it in a shop and it's of Merchanable Quality and fit for purpose then it's tough luck. You have no right to a refund just because you have seen the item cheaper somewhere else.
Hope that helps.0 -
Thanks everyone. The purchase was made in-store with my personal credit card, so it is my own device which I will use from time to time for business (I have an online business). As it was made in-store does this exempt me from a cooling off period?
Annoyingly this was quite an impulse buy and I have since found several places selling it online for far cheaper too.
However I accept that if I don't have any consumer rights I will have to keep it and learn to shop around first in future!BSC member 2040 -
Unfortunately from what you are saying you can ask nicely at the shop but they would be completely within their rights to say no.....
Sorry!!!0 -
Well they did say they'd take it back - with a 10% restocking fee - pretty generous I'd say considering

Thanks for all of the advice, it paid to call in the end and just ask the question!
