hi there, just wondering whether there has been any success in reclaiming the above?
We took out the mortgage end of 2009. at the time I worked for the fire service and my husband was in the royal navy (he had full sickpay, redundancy and life cover with his job) we were told at the time we needed to have life cover to get our mortgage so we agreed, we were then told because I wasn't guaranteed to ever keep my job I needed unemployment etc... I asked whether I could be insured alone as my husband had good benefits with the navy and we were told joint mortgage, joint life insurance to the same level of cover. so in short my husband was insured for things he didn't need and we were paying 160 a month for this cover..... This cover would not have paid out if my husband was killed or injured on active service either!!!!
in 2012 we were reviewed, a financial affordability was conducted which concluded we needed 2000 a month to pay our bills. my husband at this time earned more than this so could have covered everything if I was to lose my job and if my husband became ill he would have received his full pay (and if redundant receive a pay out plus my wages would have only been 200 short a month)
im pretty sure we were missold, the cheeky !!!!!!s even sold us house insurance as part of our mortgage and upgraded our bank account to ultimate reward at a cost of 15 a month because apparently our house insurance didn't cover emergency call outs!!!
do you think I have a good chance? or should I stop dreaming?

in 2009, no lender insisted on life assurance. Although most people did and continue to take out life assurance on their mortgage for obvious reasons. Its best not to mix up different segments of the TMPP. Multi-segment plans are a combination of different benefits. So, you could have one segment that is good and one that is bad. The advice is correct in that having a joint mortgage would mean that joint life assurance is best advice. You wont win on that complaint. Employer benefits are largely irrelevant unless you have other life assurance policies that could be used. Employer death in service is rarely enough for a couple as it is meant to go some way to replace lost income in the short term and reduced pension benefits. it is not designed to cover a mortgage as well.so in short my husband was insured for things he didn't need and we were paying 160 a month for this cover
£160pm is a lot for life cover and MPPI. Is there any other benefits included in that? (e.g. income protection or critical illness cover)do you think I have a good chance?
No chance on the life assurance element but the MPPI element is possible. Halifax tend to roll over easily on PPI complaints.I am an Independent Financial Adviser (IFA). Does it actually say this in the Terms and Conditions? or is this something you have assumed or someone unfamiliar with the policy has told you, I ask because as far as the life cover is concerned my experience is that most life policies will pay out in the circumstances you describe, the only restriction being that you can't apply for life cover if you are already "under orders" to go into active service.0
