Has anyone had a similar problem to mine? Will try to be brief, Summer 2012 bought some furniture from 'oakfurniture land' paid a deposit and had option of paying balance at one go or monthly installment. Sent off balance following February by due date.Nearly 2 years later they contact me to say am in arrears with payments, apparently because they did not cash my cheque until 8th of March they had used my settlement cheque of over £1000 to cover monthly payments for nearly two years. Have had conversation s with them but they will not budge, it wasn't my fault they delayed cashing cheque, now threatened with court action, l am pensioner with lifetime serious disabilities and this is threatening health further, can anyone help, please

What do you mean you sent it "by due date"?
How long before the money was due did you send it?0 -
Only a couple of days before it was due but was housebound due to bad weather and health (live in a very remote area of Highlands) have explained this but just not willing to listen and feel that the person who received my payment should have realised the cheque was for the exact amount owing to clear loan, thank you for your interest0

I'm afraid leaving it until a couple of days before payment is due is nowhere near enough notice.
They must receive cleared payment by the due date or else the interest period starts. On the very first day they add the whole 12 months worth of interest which had been acruing since the day the agreement started.
By all means try writing a letter of complaint but you are hoping for goodwill from them.
If they hide behind their terms, you will be stuck with the "interest acruing remainder"0 -
Yep, as has been said. If you live in a very remote area of the highlands then you should have made allowances for that in sending payment off in plenty time. Sending a cheque (which takes a few days to clear anyway) through the post only a couple of days before the deadline was always going to be a bit foolish.
Sorry OP, but doesn't really sound like they're in the wrong here. If you were trapped in the highlands due to very bad weather it's entirely possible that's why your cheque wasn't cashed immediately. Not the company's fault."Facism arrives as your friend.
