bankruptcy questions

Morning guys,

hoping some of you wonderful people can answer my question on bankruptcy.
im looking at going bankrupt after being left with a lot of debt by my husband. I have the support of a grant from a benevolant fund so im lucky that it will be funded.Ive been reading up on it bit cant find the answer to this.
For what point of my bills does the bankruptcy apply, eg for utility bills will it only apply for the amount of goods that has actually been invoiced or will they npt be able to invoice me for the goods used since the last invoice but previous to the bankruptcy?.
Im thinking that through no fault of my own I'm going to get an over payment of tax credits (I changed to part time, work paid me full time for 3 further months and are recovering the overpayment from future wages - hence pushing me over my tax credits estimation). If I go bankrupt now, will I still owe the full overpayment or will the bankruptcy cover it? Shall I wait til April to go bankrupt? . I don't want to go through bankruptcy and then immediately land a big bill.

  • On the date of your BR, all debts you have whether named on the petition or not will be included. For Council Tax - it may be that you find the whole current years bill is included but in terms of utility bills - most suppliers will write to you (the OR will tem them you are BR) opening a new account from the date of BR with a zero balance and you will start paying from that date forward as normal. However, I would be careful with your phone /internet and keep paying those if possible.

    For new peeps, please be aware that BR only covers all unsecured debts at the time of going BR :)

    Hi guys, more questions I'm afraid.
    I have my bankruprcy appointment booked at the court for tuesday. Will i walk out of there as a bankrupt person? If so, my wages are due to me next friday, they will have around 650 deductions for court orders and overpayments. If im already bankrupt before these wages are paid to me will i be able to claim back the deductions as such? Im sure our final run for wages to be paid will be tuesday so i will be too late to stop them being deducted.
    Thanks in advance, im sure theres plenty of more questions to come from my direction. I really appreciate your help.

    Providing the Judge has recognised you have sought advice beforehand....[it is rare for a BR to be refused]....you are Bankrupt from the exact minute the Judge stamps the petition.

    It is usual [? these days?] for the OR's Office to call you at Court, to obtain current information regadingfianaces, bank accounts, etc. At this time, inform the OR about the impending deductions. You can also contact the relevant offices, quoting your BR reference number, although, if the deductions are automatic, it is doubtful they will be stopped in time.

    For other creditors,there is no obligation for you to do any contacting....that is the OR's responsibility....
    No, I don't think all other drivers are idiots......but some are determined to change my mind.......

    I am determined that this will change my life for the better. I've been living in a depression recently so i need to use this weight off of my shoulders to improve my life.

    Hi bob, please let me know how it goes today, as i have an appointment on monday and have no idea what to expect. I'm going nuts tring to work out expenditure etc, despite the fact i dont actually have any personal income. I am unemployed and my missus works part time

    Hi Bob,
    Don't stress it was really easy. I only needed 2 copies of the paperwork, handed them into the office with the cheque, the lady then looked through the papers to ensure they were filled in correctly. I was then asked to wait whilst it was presented to the judge, i waited about an hour and a half but the lady then returned with a letter saying i was now bankrupt. Really easy and i came away feeling so less stressed.
    Good luck. Now for the clean up with mine and my life!
